General Terms and Conditions (GTC) – “Villa Emely” Landlord:
Oliver Roth Bertoldstr.44 79098 Freiburg 1. arrival / departure Saturday from 16.00 o’clock to the following Sunday at the latest 10.00 o’clock. Arrival and departure times
also apply to individually agreed weekdays. Departure must take place on the day of departure by
10.00 a.m. at the latest.
Other arrival and departure times can be agreed individually with the landlord.
If the tenant does not appear by 10.00 p.m. on the day of arrival, the contract is deemed to have been terminated after a
period of 48 hours without notification to the landlord. The landlord
or his representative may then freely dispose of the property. A (pro rata)
repayment of the rent due to early departure does not take place in principle. 2. special requests and additional agreements
are generally possible. They require written confirmation by the landlord. 3. payment
The rental agreement becomes valid upon receipt of the deposit on the landlord’s account
. The deposit of 30% of the rental amount is due for payment within seven days
of receipt of the booking documents. After the down payment has been made, payment of the remaining amount is due
30 days prior to departure. If the payment deadlines
are not met, the landlord may withdraw from the contract.
Non-payment is deemed to be a withdrawal from the contract
and entitles the tenant to re-let the property.
Additional costs for water, parking space, waste and energy costs are not charged. 4. withdrawal
You can withdraw from the contract at any time.
Withdrawal must be made in writing. In the event of withdrawal, you are obliged to compensate us
for the damage incurred:
– from the day of booking confirmation by the landlord to the 90th day before the start of the rental period
no compensation
– from the 89th day to the 61st day before the start of the rental period 10% of the total price . from the 60th day to the 31st day before the start of the rental period 20% of the total price . 20% of the total price
– from the 30th day to the 15th day before the start of the rental period 50% of the total price
– from the 14th day to the 8th day before the start of the rental period 80% of the total price
In the event of cancellation less than eight days before the start of the rental period, the full travel price must be paid.
The date of receipt of your notice of cancellation counts in each case.
Amounts already paid in
will be offset.
You can provide a replacement person who will enter into your contract under the conditions stated at

The tenant undertakes to treat the rented property (vacation home, inventory and
outdoor facilities) with care. If damage occurs to the
vacation home and / or its inventory during the tenancy, the tenant is obliged to notify
the property management immediately.
Defects and damage discovered on arrival must be reported immediately to the
property management, otherwise the tenant is liable for this damage. A reasonable period of time must be allowed for
rectification of damage and defects.
Claims arising from complaints that are not reported immediately on site are
excluded.
Complaints that are only received by the landlord at the end of the stay or after leaving
the vacation home are also excluded from compensation
.
In the event of any service disruptions, the tenant is obliged to do everything reasonable within the scope of
his legal obligation to help remedy the disruption
and to keep any damage incurred to a minimum.
On the day of departure, the tenant must remove personal belongings, dispose of household waste in
the bins provided and store clean and washed dishes in the
kitchen cupboards. 6. data protection
The tenant agrees that within the framework of the
contract concluded with him, necessary data about his person will be stored, changed and / or deleted
. All personal data will be treated with absolute confidentiality. 7. liability
The advertisement has been prepared to the best of our knowledge. No liability is accepted for any influence on the
rental property caused by force majeure, normal power and water failures and
storms.
Similarly, no liability is accepted in the event of unforeseeable or
unavoidable circumstances such as official orders, sudden construction sites or for
disruptions caused by natural and local conditions. However, the landlord will be happy to assist in
rectifying the problems (where possible).
The landlord accepts no liability for the use of the play and sports equipment provided
.
The arrival and departure of the tenant is the responsibility and liability of the tenant. The
landlord is not liable for personal belongings in the event of theft or fire. The tenant is fully liable for willful
destruction or damage. 8. final provisions
Photos and text on the website or in the flyer serve as a realistic description. The
100% correspondence with the rental property cannot be guaranteed. The
landlord reserves the right to make changes to the furnishings (e.g. furniture), provided they are of equal value

Should one or more provisions of these terms and conditions be or become invalid
, this shall not affect the validity of the remaining provisions.
The invalid
provision shall be replaced by a valid provision that comes as close as possible to the economic and legal
intention of the contracting parties.
German law shall apply. The place of jurisdiction and place of performance is the place of residence of the lessor.
